Legal Warranty

The products purchased on the website are subject to the provisions regarding the legal warranty of conformity as set forth by Articles 128-135 of Legislative Decree No. 128-135 of the Consumer Code. The legal warranty is reserved for consumers and, therefore, applies only to users who have made a purchase on the Acerbis website for purposes unrelated to entrepreneurial, commercial, craft, or professional activities they may engage in. For those who have made a purchase on the site but do not qualify as consumers, the specific provisions of the Italian Civil Code in this regard will apply.


CONTENT

Pursuant to Article 133 of the Consumer Code, the seller is responsible to the consumer for any conformity defect existing at the time of delivery of the product, which manifests itself within two years from the delivery date of the goods to the consumer. To benefit from the legal warranty, the consumer must provide proof of purchase from the Acerbis website, as well as proof of the delivery date of the goods.

The legal warranty applies provided that the product has been used correctly and with due care, meaning in accordance with its intended purpose and as described in any technical documentation, while following the operational guidelines indicated therein.

The warranty does not cover any damage, malfunction, or defects caused by accidental events, user negligence, or improper use or maintenance (e.g., washing) of the product.

The warranty is personal and applies solely to the original purchaser, being reserved exclusively for those who made the purchase on the Acerbis website. Therefore, it is advisable to retain documents that can prove the purchase (e.g., purchase invoice and/or credit card statement) from the Acerbis website. Unless proven otherwise, defects in conformity that appear within twelve months from the delivery date are presumed to have existed at that date, unless such assumption is incompatible with the nature of the product or the nature of the conformity defect.


PROCEDURE TO FOLLOW TO BENEFIT FROM THE WARRANTY

To make use of the legal warranty, you must report the conformity defect within two months from the date you discovered the defect by sending a communication to the email address: ecom@acerbis.it. We kindly ask that you attach the following documentation to your communication:

  • Photographic documentation related to the defect or fault of the product you purchased, supporting the claim of non-conformity;
  • Documentation proving the purchase of the product from the Acerbis website;
  • Documentation proving the delivery date of the product.

Our customer service department will contact you promptly, and if, based on the photographic documentation, we find the warranty claim to be valid, you will be provided with the procedure to follow to arrange for the return of the product. The product must be returned with its original packaging and all accessories and documentation received upon delivery, as failure to do so may prevent us from verifying the operability of the warranty.

If, upon receiving the product, we verify that the warranty is valid, we will restore the product's conformity by repairing or replacing it or offering a price reduction, up to the resolution of the online sales contract and refunding the paid price. The amount of the refund or reduction will be communicated via email and credited using the same payment method used for the purchase. Alternatively, you may choose to receive a voucher, redeemable on the website, equivalent to the refund or reduction amount to which you are entitled.

If, however, upon receiving the product, we verify that there is no conformity defect and the warranty is not applicable, we reserve the right to charge you for the verification and restoration costs, as well as the related shipping costs. In such a case, you may choose to have the purchased products returned to you at your own expense once you have settled any amounts due to us. If you refuse the return of the product, we reserve the right to retain both the products and the corresponding payment for the purchase.
